Terms & Conditions of Use - Consult Buddy

1. Acceptance of Terms

By downloading, installing, accessing, or using the Consult Buddy application (“App”), you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree, you must not use the App.

If you are using the App on behalf of another person (for example, as a parent, guardian, or caregiver), you represent that you are legally authorized to do so.

You must be at least 18 years old, or use the App under the supervision of a parent or legal guardian where permitted by law.

2. Purpose of the App

The App allows users to enter, store, organize, and use their personal medical information in conjunction with artificial intelligence tools.

Its purpose is to generate questions, prompts, summaries, and informational material to help users prepare for consultations with qualified healthcare providers.

The App is designed to support — not replace — professional clinical care.

The App is not a substitute for professional medical advice, diagnosis, or treatment.

3. No Medical Advice

The App does not provide medical advice.

Any content generated by the App, including AI-generated material, is provided solely for informational and educational purposes.

The App is not a medical device and is not intended to diagnose, prevent, monitor, predict, treat, or alleviate disease.

Always seek the advice of your physician or other qualified health provider with any questions regarding a medical condition.

Never disregard, avoid, or delay obtaining medical advice because of information obtained from the App.

If you believe you may be experiencing a medical emergency, contact emergency services immediately.

4. AI Interaction and Limitations

Conversations within the App are facilitated by artificial intelligence (“AI”) provided by third-party technology vendors.

AI systems:

  • generate probabilistic outputs
  • cannot verify medical accuracy
  • may produce incomplete, outdated, biased, or incorrect information
  • do not exercise clinical judgment

Output should not be relied upon as a sole basis for healthcare or personal decisions.

Consult Buddy makes no representations or warranties regarding the accuracy, completeness, or suitability of AI-generated content.

5. User Responsibilities

You are solely responsible for:

  • the accuracy and completeness of the information you enter
  • ensuring information submitted belongs to you or that you are authorized to provide it
  • maintaining the confidentiality of your login credentials
  • all activity conducted under your account

You must not input offensive, harmful, malicious, or unlawful content.

6. Data Storage and Privacy

Personal and medical information you provide is stored securely and handled in accordance with applicable privacy and data protection laws.

Please review our Privacy Policy to understand how your data is collected, used, safeguarded, and disclosed.

By using the App, you consent to the storage, processing, and use of your personal health information as described.

7. Disclosure to Third Parties

We do not sell, share, rent, or otherwise commercially disclose your personal or health information.

We engage a limited number of trusted service providers to support the secure operation of the App. These providers are contractually required to safeguard data and may process information only on our behalf.

Anthropic, PBC (Claude AI)

  • Provides AI processing services to generate responses to user prompts.
  • Acts as a data processor/service provider.
  • Processes data solely to deliver AI functionality.
  • Does not use customer data to train its models unless explicitly authorized by Consult Buddy.
  • Receives only the information necessary to provide the service.
  • Retains data only as long as reasonably necessary for security, abuse monitoring, and operational integrity in accordance with its privacy commitments.

Cloud Infrastructure Providers (e.g., Amazon Web Services)

  • Provide secure hosting and encrypted storage of health and medical data.
  • Maintain administrative, technical, and physical safeguards aligned with global security standards.
  • Process data solely under contractual data-processing obligations.
  • Delete or irreversibly de-identify data following verified account deletion, subject only to limited backup retention required for security and disaster recovery.

We may access de-identified and aggregated usage statistics to maintain safety, improve system performance, and enhance user experience. Such data cannot reasonably be used to identify individual users.

8. Intellectual Property

All intellectual property rights in the App, including text, graphics, logos, software, and design, are owned by or licensed to Consult Buddy and its parent company.

You may use the App only for personal, non-commercial purposes.

No rights are granted except as expressly stated in these Terms.

9. Prohibited Use

You agree not to:

  • use the App for unlawful purposes
  • reverse engineer, modify, exploit, or interfere with the App
  • attempt to gain unauthorized access to systems or data
  • upload malicious code
  • misuse AI functionality

We reserve the right to suspend or terminate accounts that violate these Terms.

10. Availability and Updates

The App may be updated, modified, suspended, or discontinued at any time without notice.

We do not guarantee uninterrupted access, availability, or error-free operation.

Features may evolve in response to technological, clinical, or regulatory developments.

11. Limitation of Liability

To the maximum extent permitted by law, Consult Buddy and its developers, affiliates, officers, employees, and contractors are not liable for any loss, injury, or damages arising from:

  • your use of the App
  • reliance on its content
  • AI-generated outputs
  • data entry errors
  • service interruptions
  • third-party technology providers

This includes direct, indirect, incidental, consequential, and special damages.

Where liability cannot be excluded, it is limited to the minimum amount permitted by law.

12. Indemnity

You agree to indemnify and hold harmless Consult Buddy and its affiliates, officers, employees, and partners from any claims, damages, losses, or expenses arising out of:

  • your use of the App
  • breach of these Terms
  • violation of applicable laws
  • infringement of third-party rights

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Victoria, Australia.

Nothing in these Terms excludes mandatory consumer or privacy rights applicable in your jurisdiction.

14. Changes to Terms

We may update these Terms from time to time to reflect legal, regulatory, security, or technological changes.

Continued use of the App after updates constitutes acceptance of the revised Terms.

Where required by law, we will provide notice of material changes.
